Terms of Service

1. Acceptance of Terms

By accessing or using BoatPassport (the "Service"), operated by LOMA Enterprise FL LLC, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BoatPassport provides digital safety attestation and rental-management services for boat rental operations, including:

• FWC-compliant safety briefing and attestation forms
• Digital signature collection and waivers
• PDF certificate generation and badge verification
• Booking, payment processing, and customer notifications (SMS/email) where applicable

3. User Responsibilities

You agree to:

• Provide accurate information in all forms and registrations
• Use the Service in compliance with all applicable laws
• Not misrepresent your identity or attestation status
• Not attempt to circumvent any security measures

4. FWC Compliance

BoatPassport facilitates compliance with Florida Fish and Wildlife Conservation Commission (FWC) requirements under Rule 68D-34.002, F.A.C. Ultimate responsibility for compliance rests with the boat rental operator and renter. BoatPassport does not guarantee regulatory compliance.

5. Operator Accounts

Operators who register for accounts are responsible for maintaining the security of their account credentials. Subscription fees are billed according to the selected plan. Operators are also bound by the BoatPassport Operator Subscription and Services Agreement they electronically sign at sign-up; that Agreement governs the operator relationship and controls in the event of any conflict with these Terms.

6. Messaging

Where enabled, the Service sends transactional text messages and emails related to bookings (confirmations, reminders, safety-attestation links, and payment links). Text messaging is optional: a customer receives texts only if they affirmatively opt in through a separate, unchecked checkbox at booking, and opting in is never required to book. Message frequency varies; message and data rates may apply. Reply STOP to opt out or HELP for help. See our Privacy Policy for how messaging data is handled.

7. Payment Terms

For paid services, you agree to pay all applicable fees. Renter booking and rental payments are processed through third-party payment processors (e.g., Square, Stripe) and are administered by the operator; any refund of a rental payment is at the operator's discretion. Operator subscription fees payable to BoatPassport are non-refundable, as set out in the Operator Subscription and Services Agreement.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service.

9. Modifications

We may modify these terms at any time. Continued use of the Service after modifications constitutes acceptance of the updated terms.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Dispute-resolution terms specific to operators (including arbitration and venue) are set out in the Operator Subscription and Services Agreement.
