BoatPassport is a software platform operated by LOMA Enterprise FL LLC ("BoatPassport," "we," "us") that provides boat-rental operators with digital FWC safety attestation, booking, waiver, identity-verification, payment, and customer-notification tools. This policy explains what information we collect, how we use and share it, and the choices you have. It applies to renters/customers, rental operators, and visitors to our websites and apps.
1. Information We Collect
Information renters/customers provide
- Name, email address, and mobile phone number
- Date of birth and home address
- Driver's license number and a photo of your driver's license, captured to complete FWC safety attestations and rental waivers
- Digital signatures and attestation/waiver responses
- Booking details (boat, dates, location) and payment information
Information operators provide
- Business identity details (legal name, address, tax ID/EIN), contact information, and account credentials
- Payment-account connection details for receiving payouts (via Square or Stripe)
- Boat, pricing, and availability data they enter to run their rentals
Information we collect automatically
- IP address, device type, browser, and operating system
- Usage data, timestamps, and diagnostic logs
- Referral source and campaign parameters (such as the page or ad that led you to a booking form)
- Essential session cookies (we do not use third-party advertising/tracking cookies)
2. SMS / Text Messaging
Consent. When you provide your mobile number while booking a boat rental through a BoatPassport operator, you consent to receive transactional text messages related to your booking — including booking confirmations, day-before reminders, FWC safety-attestation links, waiver links, and secure payment links — sent by the rental operator via BoatPassport.
Message frequency varies based on your booking activity. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help.
No mobile information obtained through SMS consent or the opt-in process will be shared with, or sold to, third parties or affiliates for marketing or promotional purposes at any time.
SMS consent is collected per rental operator at the point of booking and is not transferable. Opting out of text messages does not affect transactional emails or your booking itself.
3. How We Use Information
- Create and verify FWC safety attestations, waivers, certificates, and renter badges
- Process bookings, payments, refunds, and gift cards
- Send booking confirmations, reminders, safety-attestation links, and payment links by SMS and email
- Verify identity and prevent fraud or misuse
- Provide AI-assisted features (e.g., reading a driver's-license photo, operator assistant)
- Maintain records required by FWC regulations and operate, secure, and improve the Service
4. Driver's License & Identity Data
To satisfy Florida FWC requirements and operator waivers, renters may photograph their driver's license. The image is processed by our AI sub-processor (OpenAI) solely to read the relevant fields (name, date of birth, address, license number and expiry). This data is used only for attestation, identity verification, and rental records — never for advertising — and is retained as described in Section 7. We treat government-ID data as sensitive personal information.
5. How We Share Information
We share information only as needed to provide the Service. We do not sell personal information, and we do not share mobile/SMS opt-in data with third parties for marketing.
- Rental operators — your booking, attestation, and waiver data are shared with the operator you booked with.
- Service providers / sub-processors — listed below — who process data on our behalf under contract.
- Legal & safety — when required by law, regulation, subpoena, or to protect rights and safety.
- Business transfers — in connection with a merger, acquisition, or sale of assets, with notice.

6. Payments
Payments are processed by PCI-compliant providers (Square and Stripe). We do not collect or store full payment-card numbers; that information is handled directly by the payment processor.
7. Data Retention
Attestation and waiver records are retained for the period required by FWC regulations and our legitimate business and legal purposes. Other personal data is retained only as long as needed for the purposes described here. You may request deletion as described below; some records may be retained where law or regulation requires.
8. Security
We use industry-standard safeguards, including encryption in transit and at rest, access controls, and signed, time-limited links for sensitive actions. No system is perfectly secure, but we work to protect your information and limit access to those who need it.
9. Your Rights & Choices
- Access, correct, or request deletion of your personal information
- Opt out of text messages (reply STOP) or marketing emails (use the unsubscribe link)
- Request a copy of the data we hold about you
Depending on your state of residence (e.g., California), you may have additional rights; contact us to exercise them and we will not discriminate against you for doing so.
10. Cookies
We use essential cookies to keep you signed in and maintain session state. We do not use third-party advertising or cross-site tracking cookies.
We store campaign identifiers in first-party browser storage for up to 30 days so a booking can be attributed to the ad or page that led to it. This is not shared with third parties and is not used for cross-site tracking.
11. Children's Privacy
The Service is intended for adults (18+). We do not knowingly collect personal information from children under 18.
12. Changes to This Policy
We may update this policy from time to time. Material changes will be posted on this page with an updated "Last updated" date.
